Taxes on airline tickets eligible for a refund.

August 1, 2011 By Terence Nilson Leave a Comment

Dear Customer,

The Fed Aviation Administration’s authority to gather ticket tax and other aviation-related taxes expired on Fri. , July twenty-two, 2011. Any ticket issued before July twenty-three, 2011, containing these taxes for travel beginning 12:01 am July twenty-three, 2011, might be according to the IRS, fit for a tax refund. What’s not yet known is the precise refund period, because each day the

FAA goes unfunded, another day is added to the period that is acceptable for money back. The taxes suitable for a reimbursement are : The 7.5 % tax on the base ticket price ; The domestic segment tax of $3.70 per head per segment ( a single takeoff and single landing ) ; The world travel facilities tax of $16.30 per individual for flights that begin or end in the U.S, or $8.20 per head for a flight that starts or ends in Alaska or Hawaii ; and The 6.25 p.c tax on the amount paid for transporting property by air. It is very important to notice the excise taxes you paid on these tickets were remitted by the airline to the IRS as needed by the U.S. Tax code. The airlines aren’t holding these funds and have claimed that they don’t have any plans to process these rebates. As an alternative the airlines have identified the IRS has the right place to look for an a refund, which is where buyers got kickbacks when this same event took place in the latter ’90s. The IRS declared on July twenty-seven that refund “guidance” will be forthcoming.

For the moment, the IRS is working out the numerous subtleties of processing repayments that at last may amount to $250 million or even more. At last you’ll probably need to supply a copy of your ticket as evidence of travel. We understand the name on the ticket might not always represent the purchaser of the ticket. As a consequence, the refund procedures for company and bulk purchasers could be different to the refund procedures for individual customers. The organisation I belong to, the North American Society of Travel Agents ( ASTA ), is working on our behalf to ensure that your interests are represented as the IRS develops its techniques. We must warn you the IRS has pointed to the fact that the Congress could retroactively impose these taxes on tickets issued after 12:01 am July twenty-three, 2011 when the tax wasn’t in effect. ASTA believes it is doubtful that Congress will attempt to force airlines to turn over the “tax” on tickets bought in the no-tax period. There are serious Constitutional barriers to such action. And the issues of retroactively applying the taxes to tickets individually are enormous.

For the moment, there is little for you to do. If you have tickets that are suitable for money back, you’ll ultimately need a copy of your e-ticket bill. If you happen to have got a copy, that is great. If not, we will help you get a copy of any ticket you bought from us. If you are a big company purchaser, we suggest waiting till the IRS releases its refund procedures, which may vary for bulk consumers, and till the full “exempt period” is understood.

Many Thanks.
